privacy policy.

1. Scope and Controller
This Privacy Policy ("Policy") explains how Nuko Nova Dynamics LLC ("Nuko Nova," "Company," "we," "us," or "our") — a Florida limited liability company — collects, uses, and protects personal information in connection with our corporate website at nukonova.com (the "Site").
Nuko Nova Dynamics LLC is the controller of personal information collected through the Site.
This Policy covers the Nuko Nova corporate Site only. Nuko Nova Dynamics LLC also builds and operates separate brands and products, each of which has its own privacy policy that governs the data it collects. See Our Brands and Their Policies below.
2. Our Brands and Their Policies
Nuko Nova Dynamics LLC operates distinct brands and products. They are not separate legal entities — they are operated by Nuko Nova Dynamics LLC — but each collects different information and maintains its own privacy policy. If you interact with one of these products, the information you provide there is governed by that product’s privacy policy, not this one:
- Miami Web AI Privacy Policy — our web & AI studio, operated as a registered fictitious name (“doing business as”) of Nuko Nova Dynamics LLC.
- DropPace Privacy Policy — our mobile running app; it also maintains a separate Consumer Health Data Privacy Policy for workout and health data.
Where this Policy and a product-specific policy could both seem to apply, the product-specific policy controls for data collected through that product.
3. Information We Collect
Information You Provide to Us
When you use the contact form on the Site or otherwise reach out to us, you may provide:
- Your name
- Your email address
- The contents of your message (for example, a partnership, media, or general inquiry)
- Any other information you choose to include
Information Collected Automatically
We use Vercel Web Analytics, a privacy-focused, cookieless analytics tool, to understand how the Site is used in aggregate. It records anonymous, aggregated data points and does not use cookies, does not store your IP address as a personal identifier, and does not track you across other websites. Visitors are identified only by a hash derived from the incoming request, which is automatically discarded after 24 hours. The data points recorded may include:
- Page path and referring URL
- Approximate geolocation (country, region, and city level)
- Device type, operating system, and browser
- Event timestamp
4. How We Use Information
We use the information described above to:
- Respond to your inquiries, messages, and requests
- Operate, maintain, secure, and improve the Site
- Understand aggregated usage trends and Site performance
- Detect, investigate, and prevent fraud, abuse, or security incidents
- Comply with our legal obligations and enforce our terms
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not use the information collected through this Site for automated decision-making that produces legal or similarly significant effects.
5. Legal Bases for Processing (EEA and UK Visitors)
If you are located in the European Economic Area or the United Kingdom, we process your personal information on one or more of the following legal bases:
- Legitimate interests: to operate, secure, and improve the Site and to respond to inquiries you send us, where these interests are not overridden by your rights.
- Consent: where required by law, which you may withdraw at any time.
- Contract: to take steps at your request before entering into any engagement.
- Legal obligation: to comply with applicable laws, regulations, or lawful requests.
6. Cookies and Similar Technologies
We use only essential, first-party browser storage to operate the Site. We do not use advertising or cross-site tracking cookies, and our analytics provider (Vercel Web Analytics) does not set cookies.
| Name | Type | Purpose | Party |
|---|---|---|---|
| theme | Local storage | Remembers your light/dark mode preference | First-party |
| Vercel Web Analytics | No cookie | Anonymous, aggregated usage measurement (request-derived hash discarded after 24 hours) | First-party |
You can control browser storage through your browser settings. If we introduce any non-essential cookies in the future, we will update this section and, where required by law, present a consent banner.
7. How We Share Information
We share personal information only as needed for the purposes described in this Policy:
- Service providers: vendors that help us operate the Site, under appropriate confidentiality and security obligations (see the subprocessor table below).
- Legal and safety: when we believe in good faith that disclosure is necessary to comply with the law or a lawful request, or to protect the rights, property, or safety of Nuko Nova, our visitors, or others.
- Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate safeguards.
We do not sell personal information, and we do not share it with third parties for their own marketing purposes.
| Provider | Purpose | Location |
|---|---|---|
| Vercel Inc. | Website hosting, content delivery, and privacy-focused web analytics | United States |
This list may change as our infrastructure evolves. If we add a provider that processes personal information from the Site — for example, an email or form-delivery provider for the contact form — we will reflect it in an updated version of this Policy.
8. Data Retention
We retain personal information only as long as needed for the purposes described in this Policy:
| Data category | Retention period |
|---|---|
| Contact inquiries and correspondence | Duration of the correspondence plus up to 24 months, then deleted |
| Aggregated, anonymized analytics | Retained on an aggregate basis (non-personal) |
When personal information is no longer needed, we delete it or anonymize it, unless we are required by law to keep it longer. You may request earlier deletion as described in Section 11.
9. Security
We implement technical and organizational measures designed to protect personal information, including TLS encryption for data in transit, hosting on reputable, SOC 2-compliant infrastructure (Vercel), and least-privilege access controls. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
10. International Data Transfers
We are based in the United States, and our service providers may process information in the United States. If you are located outside the United States, your information may be transferred to and processed in a country that may not provide the same level of data protection as your home jurisdiction. Where required by law, we implement appropriate safeguards for such transfers, such as standard contractual clauses.
11. Your Rights and Choices
Depending on where you live, you may have some or all of the following rights regarding your personal information. Subject to applicable law, you may have the right to:
- Access the personal information we hold about you
- Correct inaccurate or incomplete information
- Delete your personal information
- Object to or restrict certain processing
- Withdraw consent where processing is based on consent
- Data portability — receive a copy of your information in a portable format where technically feasible
US State-Specific Rights
Residents of certain US states have additional rights under their state privacy laws. These rights are provided to the extent required by applicable law and, where not currently required, as a matter of policy. We honor the Global Privacy Control (GPC) and similar universal opt-out signals.
- California (CCPA/CPRA): the rights to know, access, delete, correct, opt out of the sale or sharing of personal information (we do not sell or share personal information), limit the use of sensitive personal information, and non-discrimination for exercising these rights.
- Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), and Texas (TDPSA): the rights to confirm, access, correct, delete, and obtain a portable copy of your personal data, and to opt out of targeted advertising, sale, and certain profiling.
- Utah (UCPA): the rights to access, delete, and obtain a portable copy of your personal data, and to opt out of targeted advertising and sale.
- Florida (FDBR): the Florida Digital Bill of Rights applies to controllers exceeding $1 billion in annual revenue. We do not currently meet that threshold, but we honor requests from Florida residents consistent with the rights described in this Policy as a matter of policy.
How to Exercise These Rights
To exercise any of these rights, contact us at hello@nukonova.com with a description of your request and the state in which you reside. We may need to verify your identity before responding. We will respond to verifiable requests within the time required by applicable law (generally within 45 days, extendable where reasonably necessary). If we decline to act, you may appeal by replying with "APPEAL" in the subject line, and you may also contact your state Attorney General. If your request concerns one of our products (Miami Web AI or DropPace), please use the contact details in that product’s privacy policy.
12. Children’s Privacy
The Site is intended for a general, business-oriented audience and is not directed to children. We do not knowingly collect personal information from children under the age of 16. If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.
13. Third-Party Links
The Site links to our own brand sites (such as Miami Web AI and DropPace) and may link to third-party websites we do not control. We are not responsible for the privacy practices of those sites, and we encourage you to review the privacy policy of any site you visit. Our brands’ policies are linked in Section 2.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we make changes, we will revise the "Last updated" date at the top of this page. If the changes are material, we may provide additional notice where appropriate. We encourage you to review this Policy periodically.
